Proposal which you now put forward is one which

has been pressed on heads of legations by Mr. Barton but rejected after careful consideration, see ny telegram No. 167 of June 26th, and 181 June 30th, on which you made no comments. We unanimously felt that such a proceeding would indefinitely delay settlement and that proposed commission having no legal status could only make recommendations which would have no binding value. Also no commission which included Chinese could be expected to reach unanimous decision while exclusion of Chinese would

merely provoke hostile critician from Chinese. Your

proposal to establish new international court of enquiry amounts of course to rejecting conclusions of heads of legations and denying them authority to recommend administrative measures in their efforts

to deal with the whole political situation. I must-

wern you that if I am instructed to suggest this

procedure to heads of legations there will be an

immediate rupture of solidarity and a renewal of

demand that His Majesty's Government should deel

with whole question by themselves, I have consulted

my United States colleague and he has authorized me

to say that he takes the same view of the result

of proposal.

In the meantime you will see from my succeeding

telegrams that as a result of message reported in

my telegram No. 214 municipal council are prepared
